Protection of the property rights of bona fide purchasers in 2025.


Property rights protection in Ukraine is always a hot topic. This is especially true for the protection of private property from state claims.
Over the years, many real estate objects have transitioned from state to private ownership. Most of these cases were legal, but there were also violations. Sometimes property was illegally transferred to private hands through document forgery and other violations. In such cases, the state has the right to demand the return of the property through the court.
Legislative changes for 2025
Recently, the situation has changed with the adoption of the Law of Ukraine No. 4292-IX. According to this law, the state cannot demand property from bona fide owners if they have owned it for more than 10 years, nor without compensation. If the court decides to return the property to the state, the owner will receive compensation.
- The law requires the plaintiff to assess the property value themselves and deposit money into the court's deposit account.
Changes in court case practice
The new rules have already impacted court practices. Now, disputes over property from state or communal ownership are resolved according to the new legislation.
