Alimony for parents - when children should provide financial support.


Ukrainian laws require adult children to assist their incapacitated parents who cannot provide for themselves. This is stipulated by both the Constitution and the Family Code.
According to lawyers from the 'Free Legal Aid' service, children are obligated to financially support their parents if they are retired, disabled, or do not have sufficient resources for a decent life. In this case, the court may order alimony, which can be calculated based on the child's income or as a fixed sum.
Circumstances under which children may be exempt from the duty to support parents
According to the legislation, children must also contribute to covering the costs of medical treatment or care for their parents in case of their illness or incapacity. However, there are exceptions, for example, if the parents have been deprived of parental rights, then children may be released from the obligation to support them.
- Additionally, if it is proven that the parents deliberately failed to fulfill their parental duties toward the children, the court may decide to exempt children from paying alimony.
- In some cases, even minor children may be required to support their parents if they have their own income.
